These terms cover what you're buying when you give Kindling, how billing and refunds work, and the small print around the notes and photos you send us. We've kept them as plain as we can.

These Terms & Conditions ("Terms") are an agreement between you and Kindling Letters ("Kindling", "we", "us"), operated by [legal business name / sole proprietor โ€” Toby Williams]. By placing an order or using kindlingletters.com, you agree to these Terms. If you don't agree, please don't use the service.

The service

Kindling is a gift subscription delivered by mail. Each month for six months we mail a physical letter that includes a chapter of an original story chosen for the recipient, along with a short personal note you write and a photo you upload. Letters are prepared and mailed by hand. The full story runs across twelve chapters over the six-month term.

Eligibility

You must be at least 18 years old to order. By ordering, you confirm the information you give us is accurate and that you're authorised to use the payment method you provide.

The recipient

By placing an order, you confirm the recipient โ€” or, if the recipient is a minor, their parent or guardian โ€” is willing to receive mail from Kindling. If a recipient asks us to stop, we will, and we'll let you know.

Our content and intellectual property

The Kindling stories, chapters, artwork, website text, and design are owned by Kindling or its licensors and are provided for the recipient's personal enjoyment only. You may not copy, resell, redistribute, or create derivative works from them without our written permission.

Acceptable use of the website

Please don't attempt to disrupt or gain unauthorised access to the site or its systems, scrape it at scale, or use it for anything unlawful.

Service availability and changes

We may update, add, pause, or discontinue parts of the service. If we discontinue a paid subscription before its term ends, we'll provide a pro-rata refund for letters not yet mailed.

Disclaimers

Kindling is provided "as is" and "as available". To the fullest extent permitted by law, we don't make warranties that the service will be uninterrupted or error-free, or that letters will arrive by any particular date.

Limitation of liability

To the fullest extent permitted by law, Kindling's total liability arising out of or relating to the service or these Terms is limited to the amount you paid for the affected subscription, and we are not liable for indirect, incidental, special, or consequential losses. Nothing in these Terms limits liability that cannot be limited under applicable law.

Indemnity

You agree to cover Kindling against claims, losses, and costs arising from content you submit or from your breach of these Terms.

Governing law

These Terms are governed by the laws of [governing-law jurisdiction โ€” e.g. State of X, USA], and any disputes will be handled in the courts of [venue], except where applicable law gives you the right to bring a claim elsewhere.

Changes to these Terms

If we make material changes, we'll update the date at the top of this page and, where appropriate, notify you by email. Changes don't affect orders already placed.
